đŽđŗ These Terms of Service are governed by Indian law including the Information Technology Act 2000, the Consumer Protection Act 2019, the Consumer Protection (E-Commerce) Rules 2020, and all other applicable laws of India.
Pixel Pass is a pay-per-hour gaming platform focused on Indian indie games, operated and registered in India. We connect Indian players with independent game developers. Players pay only for the hours they actually play, and developers earn revenue from every session.
These terms apply to all users â players, developers and visitors of the platform.
To use Pixel Pass you must:
- Be at least 13 years old as per applicable Indian laws
- Provide accurate and truthful information when registering
- Have the legal capacity to enter into a binding agreement under the Indian Contract Act 1872
- Not be previously banned from Pixel Pass
By registering you confirm that you meet these requirements and that all information you provide is accurate.
Pixel Pass operates on a prepaid wallet system:
- You must top up your wallet before playing paid games
- Wallet balances do not expire
- Wallet top ups are non-refundable once added
- Session charges are deducted from your wallet in real time at the game's hourly rate
- If your wallet reaches zero during a session the session will stop automatically
- All transactions are in Indian Rupees (INR)
All payments are processed securely by Razorpay, a licensed payment aggregator regulated by the Reserve Bank of India (RBI). We do not store your payment card or UPI details.
Wallet top ups are non-refundable. We do not offer refunds for completed gaming sessions.
In accordance with the Consumer Protection (E-Commerce) Rules 2020, exceptions may be made at our sole discretion in cases of:
- Technical errors on our platform that caused incorrect billing
- Duplicate charges due to payment processing errors
To request a refund for an exceptional case contact us at tarunfall2023@gmail.com within 7 days of the transaction. We will respond within 15 working days as required under Indian consumer protection law.
If you register as a developer on Pixel Pass:
đ° Revenue share: Developers receive 70% of all session revenue generated by their games. Pixel Pass retains 30% as a platform fee. Payouts are made via UPI to your registered UPI ID.
- You must own or have the legal rights to any game you upload
- Games are subject to review and approval by Pixel Pass before going live
- Pixel Pass reserves the right to reject or remove any game at any time
- You are responsible for paying applicable taxes on your earnings including GST if applicable
- Pixel Pass is not responsible for the content, quality or functionality of developer games
- You are responsible for maintaining your game download links and servers
- You must comply with all applicable Indian laws regarding content and intellectual property
Developers may not upload games that contain content prohibited under Indian law including:
- Content that violates the Information Technology Act 2000 or any other Indian law
- Content threatening national security or sovereignty of India
- Hate speech, communal content, or content promoting discrimination
- Obscene or pornographic content as defined under Indian law
- Content involving minors in any inappropriate manner
- Malware, viruses or harmful code
- Content that infringes on third party intellectual property rights
- Gambling mechanics involving real money without appropriate licences
Violation of these rules will result in immediate account termination, removal of all games, and may be reported to appropriate Indian authorities.
All users must:
- Keep account credentials secure and not share them with others
- Not create multiple accounts to abuse promotions or the platform
- Not attempt to manipulate session billing or wallet balances
- Not use the platform for any activity that violates Indian law
- Treat other users and developers with respect
- Not engage in any activity that disrupts the platform
We reserve the right to suspend or terminate any account that violates these rules without notice or refund.
Pixel Pass and its logo, design and code are protected under Indian intellectual property laws. You may not copy, modify or distribute any part of the platform without written permission.
Developers retain full ownership of their games. By listing a game on Pixel Pass you grant us a non-exclusive, royalty-free licence to display, promote and distribute your game on the platform for the duration your game is listed.
Pixel Pass is provided "as is" without warranties of any kind. Subject to applicable Indian consumer protection laws, we are not responsible for:
- Any loss of data or wallet balance due to technical issues beyond our control
- The quality, availability or functionality of developer games
- Any indirect or consequential damages arising from use of the platform
- Third party services including Razorpay and Supabase
Our maximum liability to any user is limited to the amount in their Pixel Pass wallet at the time of the claim.
In case of any dispute arising from use of Pixel Pass:
- First contact us at tarunfall2023@gmail.com and we will attempt to resolve it within 30 days
- If unresolved the dispute shall be subject to the exclusive jurisdiction of the courts in India
- These terms are governed by the laws of India
Consumers may also approach the National Consumer Disputes Redressal Commission (NCDRC) or their respective State Consumer Disputes Redressal Commission as per the Consumer Protection Act 2019.
These Terms of Service are governed by and construed in accordance with the laws of India. Any disputes arising from or related to use of Pixel Pass shall be subject to the exclusive jurisdiction of the competent courts in India. The platform complies with the Information Technology Act 2000, the Consumer Protection Act 2019, and all other applicable Indian laws and regulations.
We may update these terms from time to time in compliance with applicable Indian laws. We will notify registered users of significant changes by email. Continued use of Pixel Pass after changes means you accept the updated terms.
